The products offered on this page are intended for consumption, so the purchase contract is made at the time the customer issues the express confirmation of their order. For this reason, CAL FREGUES S.L., recommends reading the full legal notice and these general conditions before accepting the order.

This contract is entered into within the legal framework established for Electronic Commerce by Law 34/2002 on Services of the Information Society and Electronic Commerce, taking into account Law 7/1996, of January 15, on the organization of commerce retailer, Law 7/1998, of April 13, on general contracting conditions, Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the defence of consumers and users and Law 3/2014, of March 27. The contracting conditions are as follows:

Acceptance of the conditions. The express acceptance of these general conditions of sale is an essential condition for formalising any contractual relationship between the customer and Cal Fregues. Cal Fregues reserves the right to modify these general conditions at any time, without prior notice, and they are not applicable to bookings previously accepted and confirmed by Cal Fregues. All previous versions will be annulled and replaced by the present conditions.

Customer. Any person who purchases a digital gift voucher or pack through the website, whether they are the beneficiary or a third party, will be considered a customer.

Characteristics of the services. The characteristics of the services offered on this site appear on the screen together with their visual identification.

They are physiotherapy treatments, osteopathy, acupuncture, nutrition, urogine, pisco-coach, back school, therapeutic yoga, scrubs and physioaesthetics; and/or packs where products and treatments are combined, which the customer acquires in the form of a digital gift voucher and gift pack, respectively.

Conditions of use and validity of gift vouchers. The services included in the gift voucher must be used within a maximum period of 6 months from the date of purchase. Once this period has elapsed without having made use of the service, the beneficiary will lose the right to claim it, except in the event that an extension has been requested and obtained before the expiry date, with the express consent of Cal Fregues. Each voucher may only be extended once.

If the period of validity of the voucher (or its extension) ends without having used the service, the amount paid will not be refundable and will be considered as compensation for the availability of the service and administrative management costs.

In the event that the services purchased are only available for a period of less than 6 months, and have not been used within this period, the voucher will be automatically converted into a generic gift voucher, which may be exchanged for any other service of equal or lesser value, for the time remaining until its initial expiry.

To use the voucher, sessions must be booked in advance through the channels provided by Cal Fregues. Once the booking has been made, the voucher will be validated for that specific session, and the user will only be entitled to enjoy the service booked according to the conditions established by Cal Fregues.

Bookings. Bookings must be made at least 24 hours in advance, or further in advance on special dates such as Christmas, Easter or Holidays, and must be confirmed in writing.

Prices. The current prices which appear on the website at the time of formalization of the order will be applied. The price of each of them is detailed along with its description. VAT is included; this will be disaggregated later in the purchase process.

Languages in which the order can be made. This website allows you to place your order in Catalan, Spanish or English.

Purchase process. The customer will have to select the number of units of the desired services and click on buy or gift. The system allows the customer to review, modify or cancel the order before formalising it.

Order tracking. Orders are processed within a maximum of 48 hours. Orders can be tracked by writing to hola@calfregues.com.

Confirmation of Receipt of Order. Each time the company receives an order, a confirmation email is sent within 24 hours of receipt, except in case that it is received on holidays or weekends, in which case the confirmation will be sent on the working day following the reception day.

Payment Methods. Cal Fregues is responsible for the financial transactions and enables the payment of the order by credit card, VISA or MasterCard. The transaction is confirmed at the time the order is placed.

Security measures. The website uses information security techniques generally accepted in the industry, such as SSL, data entered in a secure page, firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorised access to data. In order to achieve these purposes, the USER accepts that the PROVIDER obtains data for the purposes of the corresponding authentication of access controls. The PROVIDER undertakes not to allow any transaction that is illegal or is considered by the credit card brands or the acquiring bank, that may or has the potential to damage their goodwill or influence them in a negative way. The following activities are prohibited under the card brands’ programmes: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Purchaser, Issuing Bank, Merchant, Cardholder or cards. 

Right of withdrawal. In accordance with the provisions of the General Law for the Defence of Consumers and Users, the customer will have the right to withdraw from the contract for a period of 14 calendar days without the need to indicate justification, except for legal exceptions.

The withdrawal period will end 14 calendar days from the day the purchase is delivered. To exercise the right of withdrawal, the customer must notify his decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax or email). You will be able to use the model withdrawal form that appears below, although its use is not mandatory. Both the email and the postal address to which you can direct your request appear at the end of these conditions of purchase.

To determine the observance of the deadline to withdraw it will be taken into account the date of expedition of the withdraw statement. CAL FREGUES S.L. will communicate without delay to the customer the proof of receipt of the said withdrawal in a durable medium, in case of receiving the exercise of this right by email.

CAL FREGUES S.L. will reimburse any payment received from the customer, including, where applicable, delivery costs, without delay and, in any case, before 14 calendar days have elapsed from the date on which it was informed of the decision to withdraw from the customer’s contract. CAL FREGUES S.L. will make the reimburse using the same means of payment used by the customer for the initial transaction, unless the customer expresses otherwise and as long as he does not incur any expenses as a result of the refund. However, if the customer has expressly selected a delivery method other than the less expensive mode of ordinary delivery, CAL FREGUES S.L. will not be obliged to reimburse the additional costs derived from it.

In the event that, during the withdrawal period of 14 calendar days following the purchase, the customer has made use of the gift voucher or the contracted pack, the amount paid will not be refunded. It will be understood that the service has been used when the booking has been confirmed and a specific session has been assigned, regardless of whether or not it has taken place. The formalisation of a reservation implies the start of the service and, therefore, the loss of the right of withdrawal in relation to this service.

Withdrawal form. CAL FREGUES S.L. provides this form to customers who, having bought a product on this website, want to withdraw from the purchase agreement. However, and in order to facilitate the right to withdrawal, all the fields of this form must be completed by the customer:

Methods of delivery. Treatment and gift vouchers are sent by e-mail and are not subject to any charges. The vouchers will be sent to the customer at the e-mail address indicated at the time of placing the order.

Pricing policy. Cal Fregues unilaterally reserves the right to modify the price of the services and/or products offered through this website, the prices in force in the advertising coinciding with the time of the formalisation of the order will be applied, in order to guarantee the customer the veracity of the price of the services.

Applicable law and jurisdiction. These conditions will be governed corin accordance with Spanish legislation in what is not expressly established. The parties agree to submit to the courts and tribunals of the domicile of the consumer any controversy that may arise from the provision of the products or services object of these Terms. In the event that the consumer is domiciled outside of Spain, the Parties expressly waive any other forum, submitting to the Courts and Tribunals closest to the city of VILAFRANCA DEL PENEDES (España).
